Mediation : Mediation is a method of resolving disputes without resorting to the courts. It is a process where a neutral mediator uses specialized communication and negotiation techniques to help the parties in resolving their disputes and conflicts. It focuses on the interests, needs and rights of the parties
Arbitration : Commercial arbitration is currently the preferred mode of dispute resolution for complex commercial disputes. Preferably when parties have included arbitration clauses in all large transactions and agreements. Resolution time by this mode is substantially less than the time taken in resorting to conventional court litigation methods. Parties submit their dispute to be resolved through adjudication by preferred arbitrator where mediation or conciliation may be preceded.
Conciliation: Conciliation is an alternative dispute resolution (ADR) process. In this process the conciliator, who meets with the parties both separately and together in an attempt to resolve their differences. They do this by improving communications, interpreting issues, encouraging parties to explore potential solutions and assisting parties in finding a mutually acceptable outcome.
